1. Agreement to these Terms
These Terms of Use ("Terms") govern your access to and use of the CommonWorks Consulting website (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
The Site is owned and operated by CommonWorks Company Limited ("CommonWorks", "we", "us"), a company incorporated in Vietnam with its registered office at 6th Floor, Goldstar Building, 284/41 Ly Thuong Kiet St., Dien Hong Ward, Ho Chi Minh City 72521, Vietnam.
2. Nature of the information on this Site
The content of this Site is provided for general information only. It describes the design, drafting and consulting support services we provide to professional clients and does not constitute an offer, quotation, or professional engineering, architectural, legal or financial advice.
All engagements with CommonWorks are governed exclusively by a separate written services agreement between CommonWorks and the client. In the event of any inconsistency between this Site and a signed services agreement, the services agreement prevails.
3. Professional certification
CommonWorks provides design, documentation and drafting support prepared to relevant standards, including Australian Standards where applicable. Unless expressly agreed otherwise in writing, deliverables are prepared for review, verification and certification by the client’s own registered or chartered professionals in the relevant jurisdiction. CommonWorks does not certify designs for construction, lodge documentation with authorities, or act as the engineer or architect of record.
4. Permitted use of the Site
You may view, download and print content from the Site for your own business evaluation purposes. You must not use the Site in any way that is unlawful or fraudulent; attempt to gain unauthorised access to the Site or its hosting infrastructure; introduce viruses or other malicious code; or scrape, harvest or republish Site content for commercial purposes without our prior written consent.
5. Intellectual property
All intellectual property in the Site — including text, graphics, logos, page design, drawings, renders and sample project material — is owned by or licensed to CommonWorks. Sample works shown on the Site may include projects delivered under client engagements; they are displayed with appropriate permissions or in de-identified form and remain subject to the confidentiality terms of those engagements. No licence to use any CommonWorks trademark or content is granted by your use of the Site.
6. Third-party links and materials
The Site may reference or link to third-party websites, software and standards bodies (for example Standards Australia, Autodesk or other tool providers). These references are provided for convenience and identification only. We do not control and are not responsible for third-party content, and a reference does not imply endorsement, sponsorship or affiliation.
7. Disclaimer and limitation of liability
The Site is provided on an "as is" and "as available" basis. While we aim to keep the information current and accurate, we make no warranty that the Site will be uninterrupted, error-free or free of harmful components, or that its content is complete or up to date.
To the maximum extent permitted by law, CommonWorks will not be liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, the Site or its content. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including any non-excludable consumer guarantees that may apply in your jurisdiction.
8. Privacy
Personal information submitted through the Site is handled in accordance with our Privacy Policy, which forms part of these Terms.
9. Changes to these Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated "Last updated" date, and your continued use of the Site after that date constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of Vietnam. Any dispute arising out of or in connection with the Site that cannot be resolved amicably shall be submitted to the competent courts of Ho Chi Minh City, Vietnam. This clause applies to use of the Site only; the governing law of any services engagement is set out in the relevant services agreement.
