1. Who we are
This Privacy Policy explains how CommonWorks Company Limited ("CommonWorks", "we", "us") collects, uses and protects personal information through the CommonWorks Consulting website (the "Site"). Our registered office is 6th Floor, Goldstar Building, 284/41 Ly Thuong Kiet St., Dien Hong Ward, Ho Chi Minh City 72521, Vietnam. We process personal data in accordance with Vietnam’s Decree No. 13/2023/ND-CP on personal data protection and, where relevant to our Australian clients and contacts, we have regard to the Australian Privacy Principles.
2. Information we collect
Information you provide. When you contact us through the Site, request a proposal, or apply for a role, we collect the details you submit — typically your name, email address, phone number, company name, project information, and, for job applicants, your CV and related career information.
Information collected automatically. Like most websites, our hosting infrastructure records basic technical data such as IP address, browser type, pages visited and access times. This is used for security and to keep the Site running reliably.
We do not knowingly collect personal information from children, and the Site is not directed at anyone under 18.
3. How we use your information
We use personal information to respond to your enquiry and prepare proposals; to deliver and manage services under an engagement; to assess job applications; to maintain the security of the Site; and to comply with our legal and tax obligations in Vietnam. We may also contact you about our services where you have asked us to or where we have an existing business relationship — you can opt out at any time.
We do not sell personal information, and we do not use it for third-party advertising.
4. Sharing and disclosure
We share personal information only where necessary: with service providers who support our operations (such as email, form-handling and hosting providers) under obligations of confidentiality; within our team on a need-to-know basis to respond to your enquiry; and with authorities where disclosure is required by law. Project information shared under a services engagement is additionally protected by the confidentiality terms of that engagement.
5. International transfers
Because we work with clients in Australia and use reputable international service providers, personal information may be transferred to, and stored in, countries outside Vietnam. Where we do this, we take reasonable steps to ensure the information receives a comparable level of protection and that transfers comply with applicable Vietnamese data protection requirements.
6. Retention
We keep personal information only as long as needed for the purpose it was collected: enquiry records for as long as required to manage the relationship, engagement records for the period required by Vietnamese accounting and tax law, and unsuccessful job applications for up to twelve months unless you ask us to delete them sooner.
7. Security
We apply reasonable technical and organisational measures to protect personal information against unauthorised access, alteration, disclosure or loss, including access controls and encrypted transmission of Site forms. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.
8. Cookies
The Site currently uses only the cookies and local techniques strictly necessary for it to function. If we introduce analytics or other non-essential cookies in the future, we will update this Policy and, where required, seek your consent.
9. Your rights
Subject to applicable law, you may request access to the personal information we hold about you, ask us to correct or delete it, withdraw consent to processing, or object to direct marketing. To exercise these rights, contact us using the details below. We will respond within the timeframes required by applicable law and may need to verify your identity before acting on a request.
10. Changes to this Policy
We may update this Privacy Policy from time to time. The revised version will be posted on this page with an updated "Last updated" date. Material changes will be highlighted on the Site where practicable.
